TERMS
& CONDITIONS
This will be completed with your agreed details and sent to you at the
time of booking, for signature and return.
It is mutually agreed that the following terms of agreement form an
integral part of this contract and that no variation or modification of
this contract shall be effective unless accepted by both Looking Glass
Photography Ltd (‘the company’) and ……………... (‘you’)
BOOKING DEPOSIT:
A deposit of £200 is required, together with a signed booking form.
Please make cheques payable to ‘Looking Glass Photography Ltd’.
BALANCE PAYMENT:
The balance is due two weeks prior to the wedding. Payment for additional photographs is made
after the wedding at the time of ordering.
FEES: Please
note that the total fee due is £(as agreed with you) of which the deposit is part. This
includes all photography, expenditure, and (the agreed number) of
prints.
CREATIVE LICENCE:
Looking Glass Photography Ltd shall be granted creative and artistic
license in relation to the choice of locations and poses used. The
judgment of the photographer on photographic style and the number of
photographs taken shall be deemed correct. The photographer will
endeavour to honour specific photograph requests but, due to such things
as changes in the weather and the availability and willingness of
subjects, does not undertake to guarantee any specific picture or
incorporate any specific background, location or group arrangement.
VIEWING: A
mutually convenient appointment for viewing of photographs will be made.
Images will be presented as agreed, from which you can choose XXX number
of images.
COPYRIGHT: The
1998 Copyright, Designs, and Patents Act assigns copyright to Looking
Glass Photography Ltd. You may not copy the photographs taken under this
contract, or allow copies to be made photographically, electronically,
or by any other means unless a specific agreement has been entered into
with Looking Glass Photography Ltd. Images on CD-ROMS can be used on
your website should you wish to create one. Unless a written request is
specifically made to the contrary, Looking Glass Photography Ltd
reserves the right to use pictures from your wedding on the company’s
marketing and advertising material including the website, flyers and
advertorials.
FORCE MAJEURE:
Upon the unlikely occurrence of an event outside the reasonable control
of Looking Glass Photography Ltd, including but not limited to
photographic failure, death, injury or sickness, the company’s liability shall
be limited to a full refund of all monies paid. Your statutory rights
are not affected. Under the above-mentioned circumstances, in addition
to refunding all monies paid, Looking Glass Photography Ltd will
undertake to present guest's photographs in as professional style as
possible in an album paid for by Looking Glass Photography Ltd.
CANCELLATION BY LOOKING GLASS PHOTOGRAPHY
LTD: If Looking Glass Photography Ltd has
to cancel this contract for reasons beyond the company's control,
including but not limited to photographic
failure, death, injury or sickness, Looking Glass Photography Ltd's liability
shall be limited to a full refund of all monies paid.
CANCELLATION BY YOU:
Within 60 days of the wedding, in order to compensate Looking Glass
Photography Ltd for loss of income, the deposit (£200) shall be
non-refundable. However, in the event that Looking Glass Photography Ltd
books another wedding for the cancelled date, then a full refund of the
deposit will be made.
POSTPONEMENT BY YOU:
Should your wedding be postponed (even if originally thought to be
cancelled), then, subject to Looking Glass Photography Ltd’s
availability, all money paid may be applied to the new wedding. In this
case, the total fee chargeable shall be that originally agreed. If
Looking Glass Photography Ltd is not available for the rearranged date,
the deposit will be non-refundable unless Looking Glass Photography Ltd
books another wedding for that date, in which case a full refund will be
made.
